How do you really want to finish a conversation?

Do you have a disclaimer at the end of your email?  You know the kind of thing I mean.   

"This email and its contents are confidential and intended solely for the use...."
 
We see a lot of these and understand completely why people might want to use them, but have you ever stopped to really read yours?
 
Have you ever thought what kind of message it sends your customers? How about what it says about you as a person and/or business?
 
You see these disclaimers are, for the most part, a complete waste of time. They are unenforceable and have no standing in British law. 
 
Let me explain. If I put a post card through your letter box which states;
 
"If you read this you agree to pay me One Million Pounds."
 
Would you expect to be held to it? Of course you wouldn't. In legal terms it is known as contracting after the fact, and you can't do it.
 
Now what about if I added onto the end a statement that forbade you from showing it to anyone else under the threat of court action. Would that make you want to do business with me? No I didn't think so. 
 
So what can you do instead?
 
Well, consider what it is you are really trying to say and say it in a friendly maybe even good humored way.
 
"We do everything possible to ensure our emails reach the right people but from time to time we may make the odd boo boo. If this email has reached you in error we would like to apologise and would be really grateful if you could let us know."
 
You could even go one step further and turn a mistake into a lead. You could offer to send out a little apology gift. This could be a nice branded notepad or something similar, that has all your contact details on it, and you could include a discount voucher to sweeten the deal.
